Couple accuses contractor of breach of contract

A Galveston couple sued a general contractor, alleging negligence and miscommunication in a home remodeling dispute.

Michael Perugini and Karyn Perugini filed a lawsuit Feb. 4 in the Galveston County District Court against Galveston General Contractors and Demus L. Westmoreland of Galveston, alleging breach of contract and negligent misrepresentation.

According to the complaint, the defendants submitted a bid to remodel their property on or about March 7, 2014, and they agreed to hire GGC to have the project completed in six weeks, signing a contract June 2, 2014.

The suit states the Peruginis paid the firm more than $25,000 but that the job was not finished. The couple was also billed an additional $7,800 on July 29, 2014, for supplies and materials that were not used on their property, the lawsuit says, and Westmoreland did not appear at scheduled meetings.

The plaintiffs allege loss of use of their home and extra utility costs, and seek reimbursement of $25,849 along with attorney fees, expenses and costs. They are represented by attorney William J. Cronin of Houston.
