An independent contractor has sued a construction company and a third party for alleged breach of contract.
Scott Ursrey of Bacliff filed a lawsuit Feb. 19 in Galveston County District Court against Feran Construction of Austin and Ryan Henderson of Spring, alleging fraud, unjust enrichment and breach of contract.
According to the complaint, Ursrey worked with Henderson as an independent contractor, traveling to potential clients to provide repair estimates and was paid a monthly base salary, plus bonuses for successful bids. In September 2014, the suit states, Henderson opened an office for Feran Construction in Houston but due to the defendant’s alleged credit history issues, it was decided to put the lease in Ursrey’s name, with expenses funded by Feran or Henderson.
Ursrey secured a one-year lease for the office and a two-year lease for Comcast services, the suit states, and Henderson then hired Feran to replace Ursrey. The parties agreed Ursrey would receive $3,000 as compensation, plus a percentage of several jobs he had previously procured for Henderson, according to the suit.
The complaint says although the lump sum was paid, the defendants withheld the bonuses, rent and utility bills.
Ursrey seeks approximately $13,000 for the commissions, $6,300 for the lease and $4,095 to pay Comcast, along with penalties, attorney fees and costs. He is represented by attorney R. Talmadge Hammock of Hammock Law Firm in Houston.
