Patient sues doctors for negligence in surgery

A Jefferson County woman has sued two obstetrician-gynecologists and their practice for alleged negligence during surgery.

Martha Nalley filed a lawsuit Feb. 6 in Jefferson County District Court against Dr. James F. Kirby, Dr. J. Coffy Peiternelle and Southeast Texas Ob/Gyn Associates in Beaumont, alleging negligence and breach of care.

According to the complaint, Nalley experienced severe pain following a laparoscopic surgical procedure Nov. 27, 2012, at Christus St. Elizabeth Hospital in Beaumont. Kirby told her that the pain was normal due to an incision and might take up to a year to heal, the suit states.

The complaint says the patient underwent a CT scan after the pain did not improve and Kirby informed Nalley the scan revealed her pubic bone had been injured during surgery, resulting in a condition called osteititis and, possibly, an infection.

The suit states Nalley's pain is severe and disabling, resulting in further medical bills for specialist consultations and pain management due to substandard care, negligence and breach of the standard of care. Nalley alleges physical pain and impairment and mental anguish.

Nalley seeks compensation for medical expenses and damages, attorney fees, expenses, and costs. She is represented by attorney Craig Lewis of the Lewis Law Firm in Houston.
