A Denton County woman filed suit against a large U.S. auto manufacturer on charges of negligence in the design and manufacturing of her vehicle she was driving, allegedly leading to her injury.
Margo Clark of Ponder brought suit on Feb. 2 in the U.S. District Court for the Eastern District of Texas, Sherman Division, against General Motors (GM) LLC of Detroit.
Clark claims that while she was driving her 2009 Pontiac G6 eastbound on U.S. 380 on or about Apr. 4, 2014, her brakes and steering wheel failed, allegedly causing her to strike another vehicle.
The plaintiff claims GM should have advised her that the failed parts were defective. She maintains that her vehicle was not crashworthy because GM should have known of safer alternative designs for the parts in question, as the parts allegedly had been identified in a safety recall. She claims GM’s omissions led to her accident.
Claiming physical and mental suffering, a reduced capacity to function and enjoy life, she seeks damages in the form of compensation for medical expenses, lost wages, attorney fees, expenses and costs.
Clark is represented by E. Todd Tracy, Stewart Matthews, and Andrew Counts of the Tracy Firm in Dallas.
