Texas City files suit for pipeline assessments

Texas City has sued a development company and several oil and gas companies over annual pipeline assessments.

The city of Texas City filed a lawsuit Dec. 31, 2014, in Galveston County District Court against Buckeye Development & Logistics, Enterprise Products Operating, ExxonMobil Oil Corporation, Impact Midstream, Houston Pipe Line Company, Koch Pipeline Company, Shell Pipeline Company and Union Carbide Corporation, citing negligence in payment.

According to the complaint, the defendants use gas known to be hazardous in the interest of profit and, accordingly, Texas City assesses fees for the permitted pipeline operation and periodically passes ordinances updating the fees. In reviewing records, the plaintiff alleges the defendants individually owe the city outstanding balances ranging from $2,671 to $307,327.

The suit alleges damages incurred by lack of payment, unjust enrichment, negligence and violation of the fee ordinance.

Texas City seeks reimbursement of the actual total amounts, attorney fees, expenses, and costs. The plaintiff is represented by attorneys Christopher Johnson and Julie Berkshire of Lyons & Plackemeier in Texas City.
