A Texas remodeler has sued Walmart, alleging negligence in an accident in one of its stores.
Nicole Antoine filed a lawsuit Feb. 27 in Galveston County District Court against Wal-Mart Stores Texas, alleging gross negligence.
According to the complaint, on July 17, 2013, Antoine was working at the Wal-Mart at 4900 Garth Road in Baytown, in the capacity of remodeling the premises, when she was assembling a cart and a latch malfunctioned, striking the plaintiff on her right knee, for which surgery was required.
Antoine alleges Walmart failed to notify the plaintiff of the defective cart or properly supervise her work. Antoine says she experienced pain and suffering, loss of future earnings, impairment, disfigurement and other damages.
Antoine seeks: compensation for medical expenses; exemplary and punitive damages between $200,000 and $1 million; attorney fees; expenses; and costs. She is represented by attorneys Michael Pierce and Sofia Bruera of Pierce Chapman Skrabanek Bruera in Houston.
