Highway 6 accident results in lawsuit

A Brazoria County mother brought a lawsuit against a driver for negligence in a 2014 accident.

Megan Linn Dungan of Alvin filed individually and as next friend of her minor son against Eric Alexander Campbell, also of Alvin, in Galveston County District Court on Dec. 23, 2014, claiming negligence in a December 2014 traffic incident.

According to the suit, the plaintiff was waiting in her vehicle in the center turn lane on Algoa Friendswood Road on Dec. 9, 2014, in order to turn onto Highway 6. The defendant, traveling west in the center turn lane, struck the plaintiff’s vehicle when he looked over his shoulder to check traffic.

The complaint states that Campbell was driving at a speed sufficiently high to deem Dungan’s car a total loss; both mother and son sustained injuries.

The plaintiff claims that the defendant breached the duty of care by failing to drive at a proper speed in the correct lane, maintain a proper lookout, brake and control his vehicle, turn to avoid collision and obey pavement markings.

Citing physical pain, mental suffering, impairment, medical expenses, loss of earning capacity and property damages, the plaintiff seeks between $100,000 and $200,000 in compensation, attorney’s fees, expenses and costs. She is represented by Gary Lee of Houston.
