A Texas City building supply company has sued a local builder, citing an outstanding bill.
Bohn's Building Materials of Texas City filed a lawsuit filed April 12 in Galveston County District Court against J.C. Cantera Homes Inc., citing breach of contract.
According to the complaint, in late 2001, Bohn's started providing building materials to Cantera for the rehabilitation of several Galveston homes, and Cantera has failed to pay for all the materials. The suit says on April 27, 2012, Bohn's send Cantera a notice of past-due invoices and on Oct. 1, 2014, Cantera's attorney replied about settling all outstanding payments.
After a misunderstanding about the full amount still due, the suit states, Bohn's sent a demand for payment of the outstanding balance on Nov. 17, 2014, and Cantera has yet to pay or respond.
Bohn's seeks a balance of $148,705.11, plus pre- and post-judgment interest, court costs and attorney fees. The plaintiff is represented by attorneys Christopher L. Johnson and Julie M. Berkshire of Lyons and Plackemeier in Texas City.
