A class action lawsuit seeks damages from a major retailer allegedly selling flooring with dangerous levels of formaldehyde.
Dianne McGreevy filed a lawsuit April 28 in the Houston Division of the Southern District of Texas against Lumber Liquidators Inc., Lumber Liquidators Leasing, Lumber Liquidators Holdings Inc., and Lumber Liquidators Services.
According to the complaint, McGreevy installed Chinese wood veneer flooring in her home. After hearing news reports the defendants' flooring had levels of formaldehyde harmful to humans, the suit says, McGreevy allowed ESML Analytical-Industrial to test a sample of her flooring.
The results, according to the lawsuit, "showed a 0.20 ppm concentration of formaldehyde ... "which well exceeds acceptable levels. McGreevy's formaldehyde testing levels indicate a high concern the chemical is a probable contributor to indoor air levels."
The plaintiff says she suffered congestion, and the suit says had she known "prior to her purchase of the flooring, that the flooring contained the levels of formaldehyde that it contains, she would not have purchased the flooring from the defendants or installed the flooring in her house."
McGreevy, as part of a class action that consists of tens of thousands of consumers, seeks in excess of $5 million, plus costs. She is represented by attorney William B. Federman of Federman and Sherwood in Oklahoma City.
