Foremost Lloyds of Texas has been sued for allegedly underpaying an insured’s claim for vandalism to her Beaumont property.
Rhonda Heartfield filed suit against Foremost on April 27 in Jefferson County District Court.
According to the lawsuit, on Aug. 26, 2014, Heartfield’s property was damaged as a result of “vandalism and malicious mischief,” prompting her to submit a claim.
“Defendant and/or its agents improperly adjusted plaintiff’s claim,” the suit states. “Because defendant underpaid plaintiff, plaintiff has not been able to properly and completely repair the damages to plaintiff’s property.”
The plaintiff accuses the defendant of insurance code violations and settling her claim in an unfair manner.
The plaintiff further accuses the defendant of malice, entitling her to exemplary damages.
She is represented by Benjamin Tenenholtz, attorney for the San Antonio law firm Speights & Worrich.
Judge Gary Sanderson, 60th District Court, has been assigned to the case.
