Staffing company awarded $27K judgment in collection suit

A Harris County man who sued over claims his company has not been reimbursed for staffing provided to a rehabilitation company recently scored an award of more than $27,000.

Orlando Bejarano, doing business as Focus Therapy Staffing, filed a lawsuit Oct. 20 in Galveston County District Court against Bolton Healthcare, doing business as Guardian Angel Home Health Care, citing breach of an agreement.

Court records show that on March 6 a judgment was entered in the case, awarding Bejarano $27,211.94 in compensatory damages, $7500 in attorney fees, $2053.20 in interest and $612.40 in collection expenses.

According to the complaint, Focus Therapy Staffing entered into an agreement with Guardian Angel Home Health Care to provide the defendant with its home rehabilitation staff for reimbursement and interest on late payments.

The plaintiff claimed he sent monthly invoices to the defendant for the services rendered to its patients but the defendant owed more than $28,000 as of Oct. 17.

The defendant is accused of breaching the agreement or, in the alternative, unjust enrichment.

Bejarano is represented by attorneys Carl Jay Quezeda and Gregory P. Crinion of Crinion Davis & Richardson in Houston.
