HOUSTON – A landscaping worker brought a lawsuit against his employer alleging liability in a 2014 incident.
Adrain Weeks, of Dickinson, filed a complaint against Lynn’s Landscaping, of League City, in Galveston County District Court on May 5, claiming injuries in a June 2014 workplace circumstance.
According to the lawsuit, Weeks fell off his employer’s pickup truck on June 17, 2014, allegedly sustaining injuries. The complaint holds Lynn’s Landscaping liable, citing negligence by failure to control, supervise, monitor, instruct and manage; and to provide assistance; necessary tools; a safe working environment including safety promotion; notice; and warning.
The plaintiff alleges violations of Texas labor code. He contends that at the time of the accident, his employer was a non-subscriber to worker’s compensation which allegedly would have provided him with medical care coverage and benefits.
Declaring the defendant responsible for its negligent acts and/or omissions, Adrain Weeks claims to have suffered severe physical and mental pain and anguish; hospital, pharmaceutical and chiropractic expenses; and loss of earning power.
The plaintiff seeks: compensation for actual damages in excess of $50,000; pre- and post-judgment interest; attorney's fees; expenses; and costs.
