Spindletop Center non-suited in case over awarded contract

The Spindletop Center has been non-suited from litigation brought by a Jefferson County company who sued over claims it was not awarded a contract on which it was allegedly the lowest bidder.

As previously reported, H. B. Neild & Sons Inc. filed a lawsuit Nov. 4 in Jefferson County District Court against The Spindletop Center.

Court records show that Dec. 10, 2014, Judge Donald Floyd, 172nd District Court, signed off an order to non-suit the defendant with prejudice.

According to the complaint, the plaintiff was the lowest bidder on The Spindletop Center’s project to make renovations to the center’s Building F in Courtyards II.

The complaint alleged the plaintiff was not awarded the contract and was not given a chance to appear before the governing body, which is a requirement per local government code.

Neild & Sons seeks an injunction preventing the defendant from awarding the contract until a hearing can be held.
