A pair of fans and one usher are suing for injuries they allegedly received when a security worker tackled them at a Drake rap concert back in 2013.

Kansas residents Drew and Angelica Talamantes, along with Texas citizen Matilda Padilla, filed suit against NPB Companies and its employee, Kenneth Ray Payne, on May 12 in the U.S. District Court for Southern Texas, Houston Division.

According to the lawsuits, on Nov. 13, 2013, the Talamanteses attended an Aubrey Drake Graham concert at the Toyota Center.

Payne, who was working security, asked the couple to leave, believing they were intoxicated. Drew and Angelica were argumentative but cooperated. As the three began to leave the area, Drew and Angelica stopped walking to speak with Padilla, who was working as an usher, asking her to call her supervisor.

“Suddenly and unexpectedly … Payne tackled the Talamanteses … to the ground. Padilla was standing so close … that she was also knocked to the ground,” the suit states.

“Payne jumped on top of Drew’s body as he lay on the ground and placed his knee into his chest and neck causing him to have difficulty breathing. Payne also jumped on top of Angelica’s body as she lay on the ground and placed his knee into her chest and neck. Angelica attempted to get on her feet (but) Payne pushed her back down to the floor and drug her body by the feet.”

As a result, Drew lost consciousness. Angelica suffered contusions to her body and broken teeth. Padilla hurt her back, neck, right shoulder, left calf, right knee and suffered a head concussion.

The suit accuses NPB Companies of negligently hiring, training and supervising Payne.

The plaintiffs claims to have suffered a total of $550,000 in actual damages.

They are also seeking an award of exemplary damages and damages for their alleged lost earnings, medical expenses, loss of consortium, loss of household services and mental anguish.
