Fishery worker files $2.5M suit for slip and fall injury, Buzbee handling case

Seeking $2.5 million in damages, a man brought a lawsuit against a seafood company and its fishing vessel for alleged workplace negligence in 2015.

Jose G. Duffoo filed against Katie’s Seafood Market LLC and the F/V Pisces LLC of Galveston, in Galveston County District Court on May 28, claiming negligence in an April 2015 workplace incident.

According to the filing, Duffoo was an employee of the defendant aboard the F/V Pisces. The plaintiff alleges that when he was instructed to pack fish on April 5, he was not provided with a slip-proof mat; fell to the boat floor, and sustained injuries to his back, elbow, foot and other body parts.

The complaint alleges that the defendants were negligent in failing to provide a safe workplace and that the vessel was unseaworthy.

Citing pain, suffering, and mental anguish, Duffoo also states that any pre-existing medical conditions were aggravated by the incident; he alleges lost wages and earning capacity; impairment and disfigurement; medical expenses; and diminished capacity for household services.

The plaintiff seeks punitive damages; compensation in the amount of $2.5 million; maintenance and cure; pre- and post-judgment interest; attorney’s fees; expenses, and costs.
