A Harris County woman is suing a Galveston County woman and her business, alleging breach of fiduciary duty.
Marsha Wyllys Juarez of Seabrook and Concord Assisted Living filed a lawsuit June 12 in Galveston County District Court against Judy Johnson and Reejud Enterprises Inc., doing business as Concord on Broadway, alleging liability in a business dispute as well as breach of loyalty and good faith.
According to the complaint Juarez is president and manager of Concord Assisted Living and Johnson is an officer of Concord on Broadway. The suit says both women owned and operated the Galveston-based Concord Assisted Living business but the defendant formed the secondary business unbeknownst to Juarez with the intention of competing with the original firm.
The suit states Johnson willfully funneled business away from the parties’ joint enterprise to her own outfit and that Juarez suffered economic damage. According to the lawsuit, Johnson acquired personal property items and residents to transfer them to her own facility.
The plaintiff requests Johnson be denied all economic recovery and benefits assigned to Juarez in the case.
Juarez seeks: up to $100,000 in compensation for actual and economic damages, pre- and post-judgment interest; attorney fees; expenses; and costs. She is represented by attorney Leonard Cox of Seabrook.
