Woman forced into medical retirement claims discrimination

Gregory Cox of Provost Umphrey

Stacey Bratton has filed a lawsuit against Exxon Mobil for being forced to take medical retirement. She is claiming discrimination.

"On July 26, 2005 plaintiff received an injury while in the course of her employment with defendant," Bratton said in her petition, adding that she received Workers' Compensation, medical treatment and benefits, but then was discriminated against by "being forced to take medical retirement by the defendant."

Nearly two years after her injury, Bratton filed her petition on April 11 with the Jefferson County District Court. Judge Donald Floyd, 172nd District Court, has been assigned to the case. She is represented by Gregory Cox of Provost Umphrey.

She is suing for the loss of past and future earnings and earning capacity, plus mental anguish.

Bratton is demanding a trial by jury. Discovery is to be conducted under level 2.

Case No. E179-108
