Beaumont man sues for injuries at Washington chemical plant

A Beaumont resident injured while working at a chemical facility in Anacortes, WA has hired the Provost Umphrey Law Firm to extract compensation for his medical expenses.

According to the plaintiff's petition, filed May 4 with the Jefferson County District Court, Jose Bazaldua hurt himself during the scope of his employment with Sulzer Chemtech USA, Inc. on Nov. 16, 2006.

The suit does not say how exactly Bazaldua was hurt, but does say he sustained permanent injuries to his foot and general body.

"Defendant is a non-subscriber under the Texas Workers Compensation laws," the suit said. "Thus plaintiff is filing this state court action against the defendant for its negligence and gross negligence."

Bazaldua faults Chemtech for failing to provide a safe work environment, failing to provide proper tools and equipment and failing to supervise him.

The suit says as a result of defendant's negligence, plaintiff has suffered physical pain, mental anguish, loss of earning capacity, disfigurement, physical impairment and medical expenses.

The plaintiff has requested to conduct discovery on Level 3.

He is represented by attorney Matthew Matheny.

Court assignment is pending.
