An Orange County resident, Ellison Crew III, hired by Morgan Buildings & Spas, Inc. to work at its Beaumont site is suing his former employer for failing to train him on how to lift a spa tub.
Crew filed his personal injury lawsuit against Morgan with the Jefferson County District Court on May 16. Court assignment is pending.
According to the plaintiff's original petition, on Dec. 4, 2006, "Crew suffered severe injuries while attempting to lift a spa in the course and scope of his employment with Morgan."
As a result of Morgan's alleged gross negligence, Crew permanently injured his shoulders "and other parts of his body," the suit said. "Morgan is not a subscriber to the Texas Workers' Compensation System."
Crew claims the incident has left him burdened with mental anguish. He faults Morgan for failing to properly train and supervise him, failing to provide adequate safety equipment and failing to provide timely medical attention, the suit says.
He is suing for loss of earning capacity, physical pain, mental anguish, impairment and medical expenses, in addition to exemplary damages and court costs.
Crew is demanding a trial by jury. He is represented by Stephen Foster, attorney for the Arnold & Itkin law firm.
