Orange residents sue contractor over roof

Dissatisfied with their fairly new roof, a pair of Orange residents are suing the two contractors who built the covering.

Jeremiah Henson and Joyce Sherrill hired contractors Richard Whitehurst and Travis Johnson to repair their roof after Hurricane Rita. They paid the contractors $7,000. And when the roof began to leak, the pair contacted the contractors, who told them they needed new windows.

"These windows cost $11,000 and the (plaintiffs') roof still continues to leak," the suit said, which was filed with the Orange County District Court on Sept. 26.

The suit alleges the defendants violated the Deceptive Trade Practices Act "when they engaged in false, misleading or deceptive acts or practices that plaintiff's relied on to their detriment."

The plaintiffs are suing for actual and treble damages.

Whitehurst is doing business as Richard allied Renovations, and Johnson is doing business as Travis Johnson Complete Residential & Commercial Repair.

The plaintiffs are demanding a trial by jury and are represented by attorney John McElroy of the Barton, Price, McElroy & Townsend law firm.

The case has been assigned to the 260th Judicial District.
