Baja Outlaw 40
Tom Jordan claims Baja Marine Corp. sold him a bum boat and has filed a Texas Deceptive Trade Practices Act against the company.
His suit was filed with the Jefferson County District Court on Nov. 30.
According to the plaintiff's petition, Jordan purchased a 40-foot Outlaw Watercraft manufactured and sold by Baja Marine Corporation.
After a period of unspecified ownership, Jordan "discovered the watercraft was not performing at the level represented by defendant," the suit said.
"Subsequently, the watercraft suffered a series of major problems rendering the watercraft unusable. Defendant, Baja was then given multiple opportunities to cure the defects in the watercraft, but has failed to do so."
At the time of the transaction, Jordan says in his suit that Baja Marine represented that the boat was new and of the best quality.
"The representations made by the defendant were false, misleading and deceptive in that the boat was not fit from the day it was purchased to the present day," the suit said. "For example, shortly after the boat was purchased, problems arose and continue to exist."
Jordan alleges Baja Marine breached its warranty and acted with fraudulent and malicious intent, the suit said.
He is suing for actual damages and all court costs.
Jordan is represented by Provost Umphrey attorney Matthew Matheny.
The case has been assigned to Judge Milton Shuffield, 136th Judicial District.
