Making her way through a parking lot, Diana Gordon slipped when she stepped in a puddle. Claiming Marine Fueling Service Inc. allowed its parking lot to become "uneven and worn" – a condition that "dangerously caused water to pool" – Gordon has filed suit against the marine fueling company.
Her suit was filed in the Jefferson County District Court on Fe. 6.
According to Gordon's petition, on Feb. 10, 2006, she was crossing the Marine Fueling Service parking lot, located at 9,000 Yacht Club Road in Port Arthur, when she "fell as a result of an uneven, worn and/or deteriorating paved section of (the) parking lot walkway."
"This uneven and worn section of the parking lot walkway caused water to pool as a result of inclement weather, as well as collected mud," the suit said. "The accumulation of such mud and water, as well as the uneven and worn nature of the parking lot walkway itself, caused Plaintiff to trip and fall (and injure herself)."
Gordon alleges Marine Fueling Service is negligent for failing to exercise ordinary care in inspecting, maintaining, and making safe the parking lot.
"The dangerous condition was proximate to an entryway of the building, and Defendant possessed actual knowledge of the condition," the suit said.
Gordon is suing for past and future medical expenses, mental anguish and impairment.
She is requesting a trial by jury and is represented by Joel Grossman of the Grossman and Waldman law firm.
The case has been assigned to Judge Milton Shuffield, 136th Judicial District.
