Dustin and Rachel Gonzalez have filed suit against Legacy Housing Ltd., claiming the company brought them a Wind Zone Category 1 mobile home when they purchased a Wind Zone 2 home.
The couple's suit was filed on April 11 in the Orange County District Court. The suit also names Signature Manufactured Homes LLC as a defendant.
According to the Gonzalez's petition, in April 2006 the couple purchased a Legacy manufactured home through its dealer, Signature. Since they lived in Orange, the couple was told they would have to buy a Wind Zone Category 2 home.
When the home arrived, it had a different serial number than the home they had purchased and was a much older home, the suit said.
"Instead of doing as promised and warranted, Legacy and Signature � delivered and installed on Plaintiffs' property a Wind Zone 1 manufactured home."
The suit accuses the defendants of committing breach of warranty, violating the Deceptive Trade Practices Act and unconscionable conduct.
The Gonzalezes are suing for actual, consequential and economic damages and mental anguish, plus all court costs.
They are represented by Russell W. Heald, attorney for the Adams & Boswell law firm.
The case has been assigned to the 128th Judicial District.
