This Just In: Recent civil suits filed in Orange County District Courts

May 5

  • Charles and Corandalette Wagner vs. Capitol County Mutual Fire Insurance Co. et al

    PA � Steve Mostyn, J � Pat Clark

    The Wagners have filed suit against Capitol County and five of its claims adjusters and insurance salespersons claiming the defendants denied at least a portion of their Hurricane Rita policy claim.

    The suit alleges the defendants committed Texas insurance Code and DPTA violations and failed to honor their contractual obligations.

    The plaintiffs are suing for actual and consequential damages, plus attorneys' fees.

  • Colton Lavergne vs. Laken and George Hamilton

    PA � Kevin Queenan, J � Buddy Hahn

    On Dec. 6, 2006, Laken Hamilton allegedly caused an automobile collision on I-10 in Rose City when she negligently failed to control her vehicle and rear-ended Lavergne's vehicle.

    The suit also faults George for negligently entrusting his vehicle to Laken.

    The plaintiff is suing for past and future medical expenses, mental anguish, lost earnings and impairment.

  • Stephanie Sims et al vs. Easter Adams

    PA � Hart Green, J � Dennis Powell

    Acting as next of friend for her minor son, Sims has filed suit against Adams, claiming that on May 6, 2006, she failed to keep a proper lookout and struck her son as he was riding his bicycle.

    The plaintiff is suing for past and future medical expenses, mental anguish, lost earnings and impairment.

  • Graig and Kimberly Racz vs. Stacie Peveto

    PA � Adam Terrell, J � Pat Clark

    On May 8, 2006, Kimberly was driving her vehicle with Graig as a passenger when Peveto allegedly failed to control her vehicle and caused an automobile collision, injuring both of the plaintiffs.

    The plaintiffs are suing for actual damages, plus past and future medical expenses, mental anguish, lost earnings and impairment.

  • Lakesha Garlow et al vs. Russell Melancon

    PA � Jonathan Juhan, J � Dennis Powell

    On behalf of herself and her minor children, Garlow has filed an automobile collision suit against Melancon, claiming that on May 23, 2006, the plaintiffs were at the intersection at 7th Street and Park, when the defendant negligently ran a stop sign and struck Garlow's vehicle, causing it to spin.

    The plaintiffs are suing for past and future medical expenses, mental anguish, lost earnings, disfigurement, loss of consortium and impairment.

  • Connie Box et al vs. Chad Morris and Susan Roberts

    PA - Jonathan Juhan, J � Buddy Hahn

    On behalf of herself and her minor son, Box has filed an automobile collision suit against Morris for allegedly negligently causing an auto wreck on June 14, 2006, in Vidor. The suit alleges Morris failed to control his rate of speed and rear-ended Box.

    The suit faults Roberts for negligently slamming her vehicle into Morris, "further causing this negligent collision."

    The plaintiffs are suing for past and future medical expenses, mental anguish, lost earnings, disfigurement and impairment.

  • Eugene Finister vs. Simco Enterprises LTD et al

    Finister has filed suit against Simco and one of its truck drivers, Daniel Summerlin, claiming that on May 30, 2006, Summerlin negligently failed to control the company's truck and slammed into the rear of his vehicle, injuring him.

    The plaintiff is suing for past and future medical expenses, mental anguish, lost earnings, disfigurement and impairment.

  • Jesse Weaver vs. David Chesson

    PA � Jerry Pennington, J � Dennis Powell

    Weaver claims he purchased nearly 10 acres of land in Vidor seven years ago for $68,000 and has been making payments on the property but the title was never transferred to his name. So when Hurricane Rita hit, Chesson received more than $10,000 in insurance benefits for the property, but allegedly never used the money to repair the property.

    The suit also alleges Chesson allowed an oil company to drill on the property in exchange for money but never shared that money with Weaver.

    Weaver is suing for actual and consequential damages, plus attorneys' fees.

  • Curtis Berry vs. Sammy Cockrell

    PA � Christopher Smith, J � Buddy Hahn
    On May 22, 2006, Berry was traveling south on N. 16th Street when Cockrell allegedly negligently failed to control his vehicle and pulled out of his driveway in front of Smith, causing an automobile collision.

    The plaintiff is suing for past and future medical expenses, mental anguish, lost earnings, disfigurement and impairment.
