This Just In: Recent civil suits filed in Jefferson County District Courts

  • Nancie Cooper vs. Domique C. and Erica McCully

    PA � Adam Terrell, J � Milton Shuffield

    On Nov. 16, 2006, the defendant allegedly failed to control her vehicle and caused an automobile collision by hitting the plaintiff. The suit does not exactly state how or where the collision occurred, but implies the defendant was pulling out of her driveway onto a public road when the collision occurred.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost earnings, impairment and actual damages, plus attorneys' fees.

  • Courtney Harrington vs. Loretta G. Rastelli

    PA � Jonathan Juhan, J � Donald Floyd

    On June 15, 2006, Harrington was driving in Groves through the intersection of FM 347 with a green light, when Rastelli allegedly failed to yield the right-of-way at the red light and slammed into Harrington, pushing her vehicle into a third vehicle.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost earnings, impairment and actual damages, plus attorneys' fees.

  • Richard Diaz vs. Elliot and Virgil Gundelach

    On July 10, 2006, the plaintiff was traveling westbound on FM 365 when defendant Elliot, attempting to turn into a private residence, failed to yield the right of way and caused an automobile collision. The suit also faults Virgil for negligently entrusting his vehicle to Elliot.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost earnings, impairment and actual damages, plus attorneys' fees.

  • David Leighly et al vs. MCH Transportation Co. et al

    David Leighly has filed suit on behalf of the late Brian Leighly, who was killed on June 5, 2006, while riding his bicycle. An MCH truck, being operated by defendant Arthur Strong, struck Brian in the 300 block of South Fourth Street in Beaumont.

    The plaintiff is suing for survival damages and funeral costs.

  • Daryl Licatino vs. Buckner Children and Family Services et al

    On July 8, 2006, the plaintiff was entering Interstate 10 when he yielded for oncoming traffic and was suddenly hit by defendant Webbie Lee Belt, who was driving a Buckner-owned vehicle.

    Licantino alleges the defendant should have kept a proper lookout and is suing the charity for past and future mental anguish, medical expenses, lost earnings, impairment and actual damages, plus attorneys' fees.

  • Petronilo and Eustaquia Castillo vs. Capitol County Mutual Fire Insurance Co. et al

    The plaintiffs are suing Capitol County and two of its claims adjusters for allegedly refusing to pay at least a portion of their Hurricane Humberto insurance claim, which struck Southeast Texas on Sept. 13, 2007.

    The plaintiffs are alleging the defendants are guilty of Texas Insurance Code and DTPA violations. They are suing for actual and consequential damages, plus attorneys' fees.

  • Patsy Harmon vs. National Lloyds Insurance Co. et al

    The plaintiff is suing National Lloyds and two of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita insurance claim.

    The plaintiff is alleging the defendants are guilty of Texas Insurance Code and DTPA violations. She is suing for actual and consequential damages, plus attorneys' fees.

  • Mindy Harris vs. Memorial Hermann Baptist Hospital

    PA � Mark Sparks, J � Donald Floyd

    After giving her car keys to a supposed valet worker at a local hospital, a Lumberton resident was surprised to learn her car had been stolen. The vehicle was later recovered at a Louisiana gas station.

    Mindy Harris claims Memorial Hermann Baptist Hospital and AVP Nationwide "negligently failed to provide any signs with regard to their valet parking procedures."

    She is seeking exemplary damages for her troubles.

  • Jana Richard vs. Maxim Healthcare Services Inc.

    PA - Sarah Frasher, J - Donald Floyd

    Alleging her infection was caused by the healthcare provider who administrated her vaccination, Jana Richard has filed suit against Maxim Healthcare Services Inc.

    "Richard seeks all resulting damages as a result of the breach, which damages include, but are not limited to, all medical bills and lost wages caused by Maxim's improper conduct plus attorneys' fees," the suit says.

  • Jody Wade et al vs. Logan's Roadhouse

    PA - John Kahn, J � Bob Wortham

    Seasoned with an unidentified "foreign object," a Hartford, Mich., woman claims she broke three teeth after chomping down on the UFO while dining at Logan's Roadhouse. She and her husband have filed suit against the restaurant.

    Jody is suing for past and future, emotional distress, mental anguish, loss of consortium, lost wages and medical expenses. Her husband is suing for lost wages and all damages allowed to him under law.

  • Troy Smith vs. Amber Young

    On April 29, Smith says he was injured when Young caused an automobile collision by allegedly failing to keep a proper lookout.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost earnings, impairment and actual damages, plus attorneys' fees.

  • Gwen Deal vs. Coca-Cola North America

    Denying any contributory negligence, a heated mother has filed suit against Coca-Cola on her daughter's behalf, claiming one of the soda company's delivery men rolled a dolly over her daughter's foot.

    Deal is suing for her daughter's pain, mental anguish, lost earnings, impairment and medical expenses.

  • J.W. Rogers vs. Lauren J. Freedman

    PA - Fred Coogan III, J - Gary Sanderson

    A run-of-the-mill family feud has spilled over into the civil realm. Acting with power of attorney for his father, a disgruntled brother has filed suit against his sister. The issue: the sister allegedly made off with the father's dog, Little Vicky.

    Seeking punitive and mental anguish damages, J.W. Rogers sued his dog-nabbing sister, Lauren Jean Freedman.

  • Lainey Bean vs. Dr. Kevin Dean et al

    More than two years ago, Lainey Bean sought medical consultation for a lump on her breast. Now, Bean claims the doctor and hospital who tended to her negligently subjected her to "further testing and multiple surgical procedures."

    Bean filed suit against Dr. Kevin Dean and Southeast Texas Surgical Associates and is suing for past and future medical expenses, impairment, mental anguish and loss of income, plus attorneys' fess.

  • Darrie Londow vs. KCS Railway

    PA - Michael Hennen, J - Gary Sanderson

    A railroad employee, Darrie C. Londow, claims it was his employer's responsibility to keep him from tripping over a mound of debris and has as a result filed suit against Kansas City Southern Railway.

    He is suing for past and future mental anguish, lost earnings, impairment, medical expenses and disfigurement, plus all court costs.
