A McDonald's customer got an unexpected side order with his cup of coffee, a freshly mopped floor which allegedly caused the man to slip and fall and break his hip.
Alleging no caution signs were put out, Carlton Carrier filed suit against Ree Inc., doing business as McDonald's, June 16 in the Jefferson County District Court.
According to the plaintiff's petition, on June 17, 2006, Carrier was a patron at the McDonald's on Martin Luther King Jr. Boulevard in Beaumont, where an employee had apparently just mopped the entire area. Carrier claims there were no caution signs and he was given no verbal warnings.
Carrier had visited the McDonald's to buy a cup of coffee and speak with people who were dining at the restaurant.
"When Mr. Carrier decided it was time for him to leave the restaurant, he then slowly got out of his seat and proceeded to the door," the suit says.
"As Mr. Carrier was walking in the aisle he then slipped which caused him to fall back with his right leg bending back underneath him on the floor. This fall on the slippery floor resulted in a broken right hip. The broken hip has caused Mr. Carrier excruciating pain and will continue to diminish his quality of life in years to come."
As of June 30, 2006, Carrier's medical bills total $59,647.90, the suit says, and the plaintiff believes future medical expenses will reach $30,000 to $50,000.
"Mr. Carrier's pain and suffering has been immeasurable since June 17, 2006, and his future pain and suffering will impact his life to his very last days," the suit says.
Carrier is also suing for exemplary damages.
He is demanding a trial by jury and is represented by attorney Troy Pradia.
The case has been assigned to Judge Bob Wortham, 58th Judicial District.
