This Just In: Recent civil suits filed in Orange County District Courts

June 9

  • Michael Gelagotis vs. Texas Department of Public Safety et al

    Gelagotis has filed suit against the state of Texas, TDPS and one of its employees, Pamela Thomas, for an automobile collision that occurred on Aug. 10, 2006. The plaintiff was traveling east on I-10 when the defendant negligently changed lanes and struck the plaintiff's vehicle.

    The plaintiff alleges the defendant failed to keep a proper lookout and is suing her and her employer for past and future mental anguish, lost wages and impairment.

  • Beverly Richardson vs. Putnam Richardson

    PA � Gary Linthicum, J � Buddy Hahn

    Beverly Richardson, who inherited part of her brother's mortgage when their mother died, has filed suit against her sibling, Putnam Richardson, seeking her share of Putnam's debt. The mother, Beverly Williams, loaned her son $100,000.

  • Ernestine Howard vs. Orange County Building Materials, Inc.

    On March 26, Howard was driving on Old Highway 90 in Vidor when a vehicle driven by an OCBM employee ran a stop sign and struck his vehicle.

    The plaintiff alleges the employee failed to keep a proper lookout and is suing his employer for past and future mental anguish, lost wages, medical expenses and impairment.

  • Randall Culp vs. Norman Highway Constructors Inc. et al

    Culp is suing Norman Highway and one of its truck drivers, Donald Walles, for negligently causing an automobile collision on Oct. 31, 2006. The plaintiff was traveling on Texas Avenue in Bridge City when Walles negligently failed to yield the right-of-way and turned in front of him, causing a collision.

    The plaintiff alleges the employee failed to keep a proper lookout and is suing his employer for past and future mental anguish, lost wages, medical expenses and impairment.

  • Lance West vs. Allstate Texas Lloyds Co.

    PA � Steve Mostyn, J � Dennis Powell

    West is suing Allstate, McFerrin Insurance Agency and several claims adjusters for allegedly refusing to pay at least a portion of his Hurricane Rita claim.

    The plaintiff alleges the defendants failed to honor their contractual obligations and perform a reasonable investigation. He further alleges they violated the Texas Insurance Code and DTPA.

    He is suing for actual and economic damages, plus attorneys' fees.
