July 23

  • Charles Gaines vs. Taste of Orleans

    PA - Jonathan Juhan, J - Donald Floyd

    Known for its lunch specials, one Taste of Orleans customer will remember the restaurant for its slick restrooms.

    As Charles Gaines was exiting the bathroom, he claims he slipped and fell in a very dark hallway. He is suing Taste of Orleans and its owners for mental anguish and medical expenses, alleging there were no warning signs present, say court papers.

  • Juliett Marks vs. Capitol County Mutual Fire Insurance Co.

    PA – Steve Mostyn, J – Milton Shuffield

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations. The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations. The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Janice Price vs. Capitol County Mutual Fire Insurance Co.

    PA – Steve Mostyn, J – Donald Floyd

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations. The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Jack Nichols vs. Conn's Appliances Inc. and Dennis Anderson

    PA – Michael Mallia, J – Milton Shuffield

    On March 5, 2008, the plaintiff was traveling westbound on route 787 when Anderson, driving a Conn's Appliances truck, allegedly failed to yield the right-of-way and turned into plaintiff's lane, striking his vehicle.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus actual damages and court costs.

  • Mitzi Poss vs. WM Leasing of Texas and Ed Cormier

    PA – Thomas Laucius, J – Bob Wortham

    The plaintiff and Cormier, a WM Leasing employee, were involved in an automobile collision at the intersection of Major and Manion on Aug. 21, 2007. The defendant allegedly failed to yield the right-of-way.

    The plaintiff is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus actual damages and court costs.

  • Keith Breiner vs. City of Beaumont

    PA – Larry Watts, J – Gary Sanderson

    A Beaumont police officer has obtained a temporary restraining order against his department, effectively prolonging his scheduled Aug. 1 termination.

    Officer Keith Breiner claims he is being fired for his assigned role in a prostitution sting at a local massage parlor. The officer says he was instructed to have sexual relations with the women at the massage parlor in order to make the felony case. Breiner claims he is now being terminated for doing his job.

    Breiner's attorney, Larry Watts of Houston, filed the petition and TRO on July 24 in Jefferson County District Court. Judge Gary Sanderson, 60th Judicial District, granted the TRO that same day.

  • Kim Melancon vs. Capitol County Mutual Fire Insurance Co.

    PA – Steve Mostyn, J – Donald Floyd

    Melancon, representing the estate of her mother, Mary Melancon, is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of her mother's Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations. The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

    Tanna and Joseph Leger vs. Petron and Phillip Ward

    PA – Randall Hart, J – Milton Shuffield

    On July 23, 2007, Tanna was traveling East on I-10 when she was rear-ended by Ward, a Petron employee. The blow caused Tanna's vehicle to be vaulted over the median and strike another vehicle. The plaintiffs assert Ward was driving in a negligently reckless manner and further fault Petron for negligently hiring and training him.

    The plaintiffs are suing for past and future mental anguish, medical expenses, lost wages, impairment and loss of consortium, plus actual damages and court costs.

  • Martin Product Sales vs. Chemtrade Refinery Services

    PA – Keith Kebodeaux, J – Gary Sanderson

    The plaintiff alleges the defendant owes the company more than $2 million in unpaid invoices for chemicals. The plaintiff is suing for actual and consequential damages.

  • Rosendo Ochoa, Sr. vs. Aimee Cormier

    PA – Barrett Lindsay, J – Milton Shuffield

    On Jan. 22, 2008, the plaintiff was traveling west on 32nd Street in Port Arthur when he turned into a private drive. Allegedly, at that time, the defendant was speeding behind him and rear-ended plaintiff's vehicle. The plaintiff is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus actual damages and court costs.

  • Dana Shields vs. Kristopher Faulk

    PA – James Lassiter III, J – Bob Wortham

    On Aug. 16, 2006, the plaintiff was operating a vehicle in Port Arthur on U.S. 69 when the defendant rear-ended her. The plaintiff is suing for past and future mental anguish, medical expenses, lost wages and impairment, plus actual damages and court costs.
