Hotel guest sues Elegante for fall in spa area

A former guest at the MCM Elegante Hotel has filed suit against the Beaumont inn, claiming its "negligently designed showers" caused her to slip and fall.

Linda Hutchinson filed her lawsuit against 304 Hotels (MCM Elegante) on Aug. 18 in Jefferson County District Court.

According to the suit, Hutchinson stayed at the hotel on April 20, 2007. She claims she slipped while walking across a wet marble floor.

"A dangerous condition … was created by water pouring out of a spa shower onto a marble floor located in the spa and salon area of the hotel," the suit says.

"A hotel employee briefly instructed plaintiff in the operation of the shower. The shower was so negligently designed and inadequately drained, that when plaintiff turned it on the water poured out of the shower area onto the surface of the marble floor outside, which guests necessarily had to traverse to enter and exit the shower."

Hutchinson alleges the water caused her to slip and fall on the marble floor and hit the outside of the shower.

"There were no safety handles to assist the user," the lawsuit claims. "No safety mats or other non-slip, non-skid type surfaces were present."

Hutchinson is suing for past and future mental anguish, impairment, lost earnings, medical expenses and disfigurement.

She is represented by attorney John Milutin of The Milutin Law Firm in Houston.

The case has been assigned to Judge Donald Floyd of the 172nd Judicial District.
