This Just In: Recent civil suits filed in Jefferson County District Courts

Aug. 13

  • Howard Kirk vs. Capitol County Mutual Fire Insurance Co.

    PA – Jessica Hallmark, J – Gary Sanderson

    The plaintiff is suing the insurance company for allegedly refusing to pay at least a portion of his Hurricane Rita damage claim.

    The suit alleges the defendant is guilty of Texas Insurance Code and DTPA violations. The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

    Joe Ballard vs. Capitol County Mutual Fire Insurance Co. et al

    PA – Steve Mostyn, J – Donald Floyd

    The plaintiff is suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of his Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations.

    The plaintiff is suing for actual and consequential damages, plus attorneys' fees.

  • Tasha Knight vs. Jamestta Guilbeaux and Cynthia Harmon

    PA – Scott Browne, J – Bob Wortham

    On July 25 the plaintiff was traveling southbound on 4th Street in Beaumont when she was struck head on by a vehicle owned by Guilbeaux and being driven by Harmon. The defendant faults defendant Guilbeaux with negligent entrustment.

    The plaintiff alleges the other defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • J.P. Wagner et al vs. James and Patricia Bell

    PA – James Payne, J – Milton Shuffield

    J.P. and Kevin Wagner and Reginald Thompson were traveling northbound when James Bell allegedly ran a red light and struck the plaintiffs. The defendant faults defendant Patricia Bell with negligent entrustment.

    The plaintiffs allege the other defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Robert Ramsey Jr. vs. city of Beaumont

    PA – Barrett Lindsay, J – Donald Floyd

    On Dec. 25, 2007, the plaintiff was traveling southbound on Martin Luther King Parkway when a city employee driving a city vehicle allegedly failed to yield when the plaintiff had the green light.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Jean Bryant vs. Rebecca Bencowitz

    PA – Kip Lamb, J – Gary Sanderson

    On Aug. 17, 2006, the plaintiff alleges the defendant negligently caused an automobile collision. The suit does not give any further details.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Nicky Hutson vs. Rowan Companies, Inc.

    PA - Kurt Arnold, J - Milton Shuffield

    Whacked on the head with a sledge hammer by a fellow shipmate, a Mississippi seaman has filed suit against his employer, claiming the company negligently failed to supervise its employees.

    The plaintiff is suing for punitive damages.

  • Danielle Talbert vs. H-E-B Grocery Company

    PA - Gilbert T. Adams, J - Milton Shuffield

    Danielle Talbert slipped and fell while shopping at a Port Arthur H-E-B, court papers say. She alleges the store was negligent for failing to guard the public from lingering "foreign substances" on its floors.

    She is suing for exemplary damages.

  • Debera Tisaby vs. Family Dollar, Inc.

    PA – James Payne, J – Donald Floyd

    A Family Dollar shopper had her clock cleaned when she slipped in a puddle of laundry detergent.

    Claiming Family Dollar negligently failed to maintain its premises, Debera Tisaby filed suit against the discount retailer. She is suing for mental anguish and medical expenses.

  • Melissa Scott vs. Willow Bluff

    PA - Kathy Colvin, J - Bob Wortham

    Around two years ago Willow Bluff nursing home employee Melissa Scott assisted some aides in lifting a 300-pound patient from a bed to a chair.

    Scott claims she hurt her back in the process and filed suit against Willow Bluff. She is suing for past and future mental anguish, impairment, lost earnings, medical expenses and disfigurement.

  • Tawana Bobino vs. Ruben Freeman Jr. and Start Trucking

    PA – Jane Leger, J – Bob Wortham

    On March 15 Freeman was towing a unit while traveling east on I-10 when his trailer hit the plaintiff's vehicle in the adjacent lane, causing the plaintiff to lose control of her vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Linda Hutchinson vs. 304 Hotels LTD

    PA - John Milutin, J - Donald Floyd

    A past guest at the MCM Elegante' Hotel has filed suit against the Beaumont inn, claiming its "negligently designed showers" caused her to slip and fall.

    Linda Hutchinson filed her suit against 304 Hotels and is suing for past and future mental anguish, impairment, lost earnings, medical expenses and disfigurement.

  • Michael Hentrich et al vs. Shaun Sauls

    PA - Michael Hentrich, J – Donald Floyd

    Individually and on behalf of his two minor children, Hentrich has filed a suit against the plaintiff, claiming he negligently caused an automobile collision on June 17, 2006.

    The suit does not give any further details.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Sharecka Bowie vs. Standard Constructors

    PA - Chris Portner, J- Donald Floyd

    The widow of a Standard Constructors employee has filed suit against her late husband's employer, claiming the company failed to keep him from being killed while he was operating a bulldozer.

    On behalf of Emory Bowie, Sharecka Bowie filed a wrongful death suit and is suing for survival damages.
