This Just In: Recent civil suits filed in Jefferson County District Courts

Oct. 31

  • Michael and Diane Pinchen vs. L.H. Chaney, Adam Young and Norman Lawrence

    PA – Michael Leija, J – Donald Floyd

    On Nov. 3, 2006, the plaintiff was driving on Highway 69 in Beaumont when a tractor trailer being driven by Young switched lanes and struck him. The plaintiff is also suing the driver's employer for negligently hiring him. The plaintiff's wife is also a party in the suit, claiming she suffered loss of services.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Gregory Hollis vs. Colonial Pipeline Co. and Industrial Coatings Contractors

    PA – Curtis Leister, J – Bob Wortham

    The plaintiff has obtained a temporary injunction against the defendant corporations in preparation for filing a lawsuit. The injunction will restrain the defendants from tampering with potential evidence. On Oct. 29, 2008, the plaintiff was injured when he fell through an opening on a tank on CPC's property.

    He is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Alexandra Jones vs. Jerome Schrapps and Southeast Texas Surgical Associates

    PA – Adam Terrell, J – Milton Shuffield

    The plaintiff claims her surgery for a sigmoid colectomy was botched on June 26, 2007, requiring her to return for additional surgeries on July 5. She is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Saundra Burks vs. Christopher Sparks and Morgan Wright

    PA – James Payne, J – Donald Floyd

    The plaintiff alleges she was in an automobile collision with Sparks, who hit her when he negligently failed to control his speed, on Nov. 30, 2007. The suit does not state why Wright is a defendant in the suit.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Lawrence and Jennifer McClendon vs. Senegal Construction and Corinthians Construction et al

    PA – Mitch Templeton, J – Milton Shuffield

    Sometime in April 2007 the plaintiffs agreed to pay the defendants $90,000 to repair their Hurricane Rita ravaged West End home. When a city of Beaumont building inspector red flagged the property, the defendants allegedly refused to bring their work into compliance and falsely represented that the property was completed.

    The plaintiffs allege the defendants are guilty of DTPA violations and are suing for actual and consequential damages, plus all court costs.

  • Another Level Eatery vs. Jefferson County

    PA – John Morgan, J - Gary Sanderson

    Another Level Eatery, the restaurant inside the courthouse, is suing the county for allegedly reneging on a deal to provide emergency food services during Hurricanes Ike and Gustav, costing the eatery around $39,000 in lost income.

    The plaintiff is suing for actual and consequential damages, plus court costs.

  • Gregory Scott Johnson vs. Arkema Inc.

    PA – Rod Squires, J – Gary Sanderson

    The plaintiff is suing the defendant for negligently requiring him to repair a machine that allegedly exposed him to toxic vapors on two occasions in 2007. He is alleging the defendant failed to properly install the machine and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Melvin and Karon Boneau vs. Tony Hubbard

    PA – Richard Lewis, J – Gary Sanderson

    The plaintiffs are suing the defendant, an alarm salesman, for representing that their new alarm system would go off their home's windows were broken. On July 27, 2007, a burglar broke into the plaintiffs' home through a window and assaulted Melvin. The alarm allegedly was armed but did not sound off.

    The plaintiffs are suing for punitive damages.

  • Darrell DeLaney vs. City of Beaumont

    PA – Jonathan Juhan, J – Gary Sanderson

    On Nov. 16, 2006, the plaintiff was walking down Tyler Street when he fell into a large hole that had formed next to a manhole.

    He is alleging the defendant failed to properly maintain the area, and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • John Smith vs. Richard Rovira and city of Beaumont

    PA – Jonathan Juhan, J – Bob Wortham

    On Nov. 6, 2006, the plaintiff was traveling down Calder Street and had stopped at a red light when Rovira, a Beaumont police officer, rear-ended him.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Flora Butler and her minor child et al vs. Gerardo and Kathryn Cuellar

    PA – Jonathan Juhan, J – Milton Shuffield

    On Nov. 26, 2006, the plaintiffs were traveling on Washington when Gerado, driving a vehicle owned by Kathryn, allegedly failed to control his speed and slammed into the plaintiff's vehicle.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.
