This Just In: Recent civil suits filed in Orange County District Courts

  • Leory Breedlove vs. Texas Fair Plan Association

    PA - Rocky Lawdermilk, J - Dennis Powell

    The plaintiff is suing TFPA for allegedly refusing to pay at least a portion of his Hurricane Rita claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    He is seeking actual and consequential damages.

  • Craft Oil Company vs. Quality Contract Services

    The plaintiff is suing the defendant to collect $8,822 on a past due invoice. The suit does not state when the plaintiff provided goods and services to the defendant.

  • Janice Self vs. Lawman Construction

    On Nov. 29, 2007, the plaintiff contracted the defendant for the construction of a home located at 8732 Kristi Lane in Orange.

    The plaintiff alleges that the defendant has breached the contract by "absconding with the money" given to construct her unfinished home.

    The plaintiff is suing for actual damages, plus mental anguish and all court costs.

  • Hoy Cooke vs. D&H Transportation and Byron Eskridge

    On Sept. 5 the plaintiff was traveling eastbound on I-10 when one of the corporate defendant's truck drivers changed lanes and forced the plaintiff into a concrete barrier.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Steven LeBeouf vs. Ronald LeBeouf

    On Aug. 31 the plaintiff went joyriding with the defendant in his "non-street legal hot-rod."

    The defendant was traveling southbound on School Road at "an extreme rate of speed when he lost control of the vehicle and ran off the road, severely injuring the plaintiff."

    The suit does not state if the two parties are related. However, the suit does accuse the defendant of driving intoxicated.

    The suit does not explain why the plaintiff was willingly joyriding with the intoxicated defendant.

    He is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    Individually and on the behalf of her minor child, the plaintiff is suing the defendant for allegedly causing an automobile collision on Dec. 12, 2006.

    The suit does not state how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    The plaintiff has filed a Lemon Law suit against the defendants for the purchase of Dodge Ram on June 30, 2007, at Tomball Dodge.

    Since the purchase, the plaintiff alleges he has had numerous problems with the vehicle, including problems with the truck's engine and electrical system.

    Under the DTPA, he is suing for exemplary damages.

  • Pete Bensler vs. Rogers Lumber Co.

    Sometime last year, the defendant was cutting timber at a neighbor of the plaintiffs and wondered onto plaintiff's property and begun cutting timber without permission.

    The plaintiff is suing for actual and consequential damages.

  • Betty Bell vs. Memorial Hermann Baptist Orange and Dr. Dionne Oliver

    On Nov. 14, 2006, the plaintiff sought medical care from the defendants and had TVT surgery performed.

    During a follow up visit, it was learned a sponge had been left inside the plaintiff and had to have an additional surgery to remove it.

    The plaintiff is suing for past and future medical expenses, mental anguish, and pain, plus exemplary damages and all court costs.
