This Just In: Recent civil suits filed in Jefferson County District Courts

  • Jeanne Greene vs. David Charpiot and Progressive County Mutual Insurance Co.

    PA - Clint Lewis, J - Milton Shuffield

    On Jan. 12, 2007, the plaintiff was one her way to Crystal Beach when she was rear-ended by a dump truck being operated by Charpiot.

    The plaintiff is suing the defendant driver for causing the incident and her insurance company for not paying her enough benefits.

    The plaintiff alleges the defendant allegedly negligently failed to keep a proper lookout and are suing for past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

  • Richard Standifer vs. Del Papa Distributing Co. and Brent Dyson

    PA - Adam Terrell, J - Donald Floyd

    A Jefferson County man has filed suit against Del Papa Distributing Company Inc. and one of its employees, alleging he was attacked by the employee while working.

    Richard Standifer was working on Dec. 14, 2006, at Del Papa, a beer distributor, in Orange when he claimed co-worker Brent Dyson caused Standifer to sustain injuries to his head, eye and body.

    He is suing for past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

  • Bessie Prevost vs. Capitol County Mutual Fire Insurance et al

    PA - Steve Mostyn, Jr., J - Bob Wortham

    The plaintiff is suing her insurance company and one of its agents for allegedly refusing to pay at least a portion of her Hurricane Rita claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    She is seeking actual and consequential damages.

    The plaintiff is suing 25 corporate defendants for allegedly exposing her benefactor to asbestos.
    Michael Osborne allegedly dies of an asbestos related illness.

    On top of exemplary damages, the plaintiff is suing for her benefactor's past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

  • Lachandra Cobb vs. Walgreen Co.

    PA - Dan Ducote, J - Gary Sanderson

    A Beaumont woman has filed suit against Walgreen Co., alleging she was seriously injured after she fell at the store.

    LaChandra Cobb was shopping at the Walgreens located at 3885 Dowlen Road in Beaumont on June 29 when she slipped and fell on a foreign object or substance.

    Because of her fall, Cobb incurred medical expenses and suffered physical pain, mental anguish, disfigurement and a loss of earnings, the suit states.

  • Ronald Langlois vs. APAC-Texas Inc.

    PA - Dan Ducote, J - Bob Wortham

    On Oct. 11 the plaintiff was involved in a motorcycle wreck. The defendant was doing construction on a feeder road near I-10 and College when the plaintiff hit a 6-inch lip while turning into the entrance of Cowboy Harley.

    The plaintiff alleges it was the defendant's fault for not warning him of the dangerous condition.

    He is suing for past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

  • Charles and Sandra Conn vs. State Farm Lloyds et al

    The plaintiffs are suing their insurance company and one of its agents for allegedly refusing to pay at least a portion of their Hurricane Rita claim.

    The plaintiffs claim the defendants breached their contract and are guilty of several insurance code violations.

    Individually and on behalf of her minor children, the plaintiff is suing the corporate defendant and one of its employees, Devin Conlon, who allegedly caused an automobile collision with the plaintiffs on Jan. 15, 2007.

    The suit does not state how the incident occurred.

    The plaintiff alleges the defendant allegedly negligently failed to keep a proper lookout and are suing for past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

    The plaintiffs claim the defendants breached their contract and are guilty of several insurance code violations.

  • Capitol Crew Construction vs. Lawhorn Insurance

    PA - Paxton Crew, J - Gary Sanderson

    The plaintiff is suing the defendant for allegedly failing to obtain worker's comp coverage for a job it was performing.
    One of the plaintiff's employees was hurt during the job and the plaintiff was forced to pay him $35,000 in benefits since the defendant had allegedly misrepresented that the company was covered.

    The plaintiff is suing for actual and consequential damages.

  • Belinda Bluiett vs. Herman Hester

    PA - Brian Sutton, J - Donald Floyd

    On Dec. 24, 2006, the plaintiff was in an automobile collision with the defendant.

    The suit does not state how the incident occurred.

    The plaintiff alleges the defendant allegedly negligently failed to keep a proper lookout and are suing for past and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses.

  • Darlene McClain vs. HEB Food Stores Inc.

    PA - Mark Sparks, J - Gary Sanderson

    A Port Arthur woman has filed suit against H.E. Butt Grocery Co., alleging she slipped on water and fell into a display of glass jars of hot sauce while shopping at H.E. B. Pantry.

    Darlene McClain was at the Port Arthur store Nov. 11, 2007, when she slipped in a puddle of water that had accumulated on the floor from a drip in the ceiling.

    "As a result of her slipping, she fell into a display of hot sauce causing glass jars to break and ultimately causing injuries to her eyes, face and body generally," the suit states.

  • Jodi Simon vs. John and James Coplen

    PA - Bruce Gregory, J - Donald Floyd

    On Dec. 19, 2006, James was driving and towing a vehicle and trailer owned by John Coplen when the axle broke of the trailer and struck the plaintiff's vehicle.

    She is suing forpast and future mental anguish, lost wages, medical expenses and impairment, plus all court expenses and actual damages.

  • Sidnitra Bias on behalf of Sidney Prevost Jr. vs. Gulf Harvest Seafood Inc.

    PA - Kurt Arnold, J - Donald Floyd

    The plaintiff is suing on behalf of Prevost, a Gulf Harvest employee who was found dead in the break room on Sept. 27.

    While on the job, Prevost hit his head and asked to go lie down. He was found dead later that afternoon.

    The plaintiff alleges no one checked up on him and the defendant negligently failed to get him medical attention.

    The plaintiff is suing for pecuniary loss, funeral expenses and mental anguish.
