Modica has filed suit against attorney Frank Calvert, of the Calvert, Eaves, Clarke & Stelly law firm, for allegedly verbally assaulting her with sarcasm.
This is not the first suit Modica has filed over being thrown out of her home.
In November, she filed suit against multiple housing officials, including President George W. Bush, alleging she may be forced into homelessness because of mismanagement at the Beaumont Housing Authority.
Modica claimed the Housing Authority of Beaumont is discriminating against the handicapped by refusing to make them a priority.
She is suing for general damages.

The defendant is suing Mobil Oil, along with 86 other companies, for allegedly conspiring to inflict him with an asbestos illness.
Some of the other defendants include Zurn Industries, CBS and Texaco.
The suit does not give specifics but does state the defendant worked as a pipefitter at several defendant Jefferson County refineries.
The plaintiff is seeking punitive damages.

On Dec. 28, 2006, Joseph Fontenot was driving a tractor trailer owned by plaintiff's insureds when a wheel flew of the vehicle driving in front of the truck and struck the truck, killing Fontenot and totaling the truck.
The plaintiff alleges the defendant negligently serviced the vehicle, causing the tire to come off.
The plaintiff is suing to recover benefits paid, which is around $75,000.

A Richardson woman has filed suit against three companies that own a hotel, alleging she tripped and fell on a gap in the hotel's pavement.
Court papers say that Maudia Durham was staying at the MCM Elegante Hotel, 2355 Interstate 10 South, when she was seriously injured after falling in a large gap in the pavement walkway between the parking lot and the hotel's main entrance.
She is suing for past and future mental anguish, lost wages, medical expenses and impairment.

A disabled woman who claims she was body slammed by security at a local H.E.B. store has filed a personal injury lawsuit seeking 10 percent of the company's assets.
Jefferson County resident Jessica Barbary claims she was shopping at the Beaumont store on 11th Street in December 2006 when she was approached by a store manager named Joey J. Haynes and an unnamed security guard. According to Barbary, the manager and guard accused her of stealing from the store.
"Defendant Haynes and John Doe, acting at Haynes's direction, intentionally and knowingly made contact with the body of Jessica Barbary by grabbing her and throwing her body to the ground with great force," the suit states.

The wife of a local refinery worker already received a settlement for a non-malignant illness allegedly caused by her husband's asbestos exposure. Now a new suit has been filed on her behalf after she died from an asbestos-related malignancy.
Denise Clements filed the suit on behalf of decedent Lola Thomas.
The suit alleges Thomas was exposed through her husband's employment as a mechanic and laborer where he was required to work with and around asbestos containing materials.
The plaintiff is seeking punitive and exemplary damages.
