This Just In: Recent civil suits filed in Jefferson County District Courts

Dec. 19

  • Sidnitra Bias on behalf of Sidney Prevost Jr. vs. Gulf Harvest Seafood Inc.

    PA - Kurt Arnold, J - Donald Floyd

    The plaintiff is suing on behalf of Prevost, a Gulf Harvest employee who was found dead in the break room on Sept. 27.

    While on the job, Prevost hit his head and asked if he could lie down. He was found dead later that afternoon.

    The plaintiff alleges no one checked up on him and the defendant negligently failed to get him medical attention.

    The plaintiff is suing for pecuniary loss, funeral expenses and mental anguish.

  • Anthony Flemings vs. Joshua Welch

    PA - Jonathan Juhan, J - Milton Shuffield

    On Jan. 13, 2007, the plaintiff was traveling on 9th Avenue in Port Arthur when the defendant ran a red light and slammed into the plaintiff.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Vicki Neel vs. Leigh Reeves and Lance Spencer

    PA - Jonathan Juhan, J - Milton Shuffield

    On Jan. 4, 2007, the plaintiff was traveling on FM 347 in Groves when the defendant allegedly failed to yield the right-of-way and slammed into the plaintiff.

    The defendant driver was driving a vehicle owned by defendant Spencer, who negligently entrusted the vehicle to him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Baldwin Hayes vs. Rita Guerrero

    PA - Brian Sutton, J - Gary Sanderson

    On Dec. 20, 2007, the plaintiff was sitting in his car which was parked in a drive way. The defendant allegedly ran a stop sign and hit another vehicle, which was pushed into the plaintiff's vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Amy Modica vs. Frank Calvert

    PA - Amy Modica, J - Gary Sanderson

    Modica has filed suit against attorney Frank Calvert, of the Calvert, Eaves, Clarke & Stelly law firm, for allegedly verbally assaulting her with sarcasm.

    This is not the first suit Modica has filed over being thrown out of her home.

    In November, she filed suit against multiple housing officials, including President George W. Bush, alleging she may be forced into homelessness because of mismanagement at the Beaumont Housing Authority.

    Modica claimed the Housing Authority of Beaumont is discriminating against the handicapped by refusing to make them a priority.

    She is suing for general damages.

  • Ben Bogan vs. Mobil Oil Co. et al

    PA - Glen Morgan, J - Donald Floyd

    The defendant is suing Mobil Oil, along with 86 other companies, for allegedly conspiring to inflict him with an asbestos illness.
    Some of the other defendants include Zurn Industries, CBS and Texaco.

    The suit does not give specifics but does state the defendant worked as a pipefitter at several defendant Jefferson County refineries.

    The plaintiff is seeking punitive damages.

  • Clarendon America Insurance Co. vs. Jackie Baxter Tire Co.

    PA - Loren Smith, J - Milton Shuffield

    On Dec. 28, 2006, Joseph Fontenot was driving a tractor trailer owned by plaintiff's insureds when a wheel flew of the vehicle driving in front of the truck and struck the truck, killing Fontenot and totaling the truck.

    The plaintiff alleges the defendant negligently serviced the vehicle, causing the tire to come off.

    The plaintiff is suing to recover benefits paid, which is around $75,000.

  • Maudia Durham vs. ICA Properties, Inc.

    PA - Robert McEwan, J - Bob Wortham

    A Richardson woman has filed suit against three companies that own a hotel, alleging she tripped and fell on a gap in the hotel's pavement.

    Court papers say that Maudia Durham was staying at the MCM Elegante Hotel, 2355 Interstate 10 South, when she was seriously injured after falling in a large gap in the pavement walkway between the parking lot and the hotel's main entrance.

    She is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Jessica Barbary vs. H.E. Butt Grocery Co. et al

    PA - Craig Schexnaider, J - Milton Shuffield

    A disabled woman who claims she was body slammed by security at a local H.E.B. store has filed a personal injury lawsuit seeking 10 percent of the company's assets.

    Jefferson County resident Jessica Barbary claims she was shopping at the Beaumont store on 11th Street in December 2006 when she was approached by a store manager named Joey J. Haynes and an unnamed security guard. According to Barbary, the manager and guard accused her of stealing from the store.

    "Defendant Haynes and John Doe, acting at Haynes's direction, intentionally and knowingly made contact with the body of Jessica Barbary by grabbing her and throwing her body to the ground with great force," the suit states.

  • Denise Clements vs. A.O. Smith Corp.

    PA - Bryan Blevins, J - Gary Sanderson

    The wife of a local refinery worker already received a settlement for a non-malignant illness allegedly caused by her husband's asbestos exposure. Now a new suit has been filed on her behalf after she died from an asbestos-related malignancy.
    Denise Clements filed the suit on behalf of decedent Lola Thomas.

    The suit alleges Thomas was exposed through her husband's employment as a mechanic and laborer where he was required to work with and around asbestos containing materials.

    The plaintiff is seeking punitive and exemplary damages.

  • Norman Chapper vs. Union Pacific Railroad Co.

    PA - Bristol Baxley, J - Donald Floyd

    The plaintiff is suing his employer for exposing him to repetitive trauma.

    He alleges the defendant failed to provide him with a safe place to work and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Amy Modica vs. Dr. Wilcox

    PA - Pro se, J - Milton Shuffield

    Modica, a homeless woman who has already filed two suits in two months, is now suing a Dr. Wilcox for allegedly giving her chest pains.

    She is seeking past and future medical expenses and mental anguish damages.

  • BGI Contractors LLC vs. Beaumont Independent School District et al

    PA - Louis Scofield, Jr., J - Milton Shuffield

    The defendant is suing the plaintiff for not accepting its bid for the construction of a new elementary school building.

    The defendant asserts it is the lowest bidder and therefore should be selected to save the tax payer money.

    The plaintiff is seeking an injunction to force the district to hire the company.

  • Donald Fowler Sr. vs. R. Messner Construction and Christian Fellowship Worship Center, Inc.

    PA - Timothy Ferguson, J - Milton Shuffield

    On May 7 the plaintiff, an R. Messner employee, was injured while working at a construction site owned by Christian Fellowship.

    The plaintiff was injured when he was struck in the head by an unsecured steel truss, which was blown off a scaffold by strong winds.

    The plaintiff alleges the defendants failed to provide him with a safe place to work and is suing for past and future mental anguish, lost wages, medical expenses and impairment.
