This Just In: Recent civil suits filed in Jefferson County District Courts

  • BGI Contractors LLC vs. Beaumont Independent School District et al

    PA - Louis Scofield, Jr., J - Milton Shuffield

    The defendant is suing the plaintiff for not accepting its bid for the construction of a new elementary school building.

    The defendant asserts it is the lowest bidder and therefore should be selected to save the tax payer money.

    The plaintiff is seeking an injunction to force the district to hire the company.

  • Jimmy and Nicola Bertrand vs. Denise White, National Tax and Compro Tax

    PA - Ken Lewis, J - Gary Sanderson

    In early 2007, the plaintiffs had their taxes done by the defendants. The defendants represented to the plaintiffs that they could buy into a tax shelter scheme to reduce their taxes.

    The plaintiffs participated in the program and were then notified by the IRS that the exemption was not allowed.

    The plaintiffs are suing the defendants under the DTPA and are seeking actual damages and mental anguish.

  • Aaron Cambell vs. Texas Windstorm Insurance Association

    PA - Tommy Yeates, J - Milton Shuffield

    The plaintiff is suing TWIA for allegedly refusing to pay him for the lost business he suffered after Hurricane Ike struck Southeast Texas.

    The plaintiff, who owns AD Cambell Enterprises, claims his policy allowed for him to recover such benefits.

    He is alleging the defendant breached its contract and is suing for actual and consequential damages, plus all court costs.

  • Samuel & Virginia Spikes vs. Frances Alberto

    PA - Rocky Lawdermilk, J - Donald Floyd

    The male plaintiff was in an automobile collision with the defendant on May 29. The plaintiff was traveling south on Fannett Road when the defendant allegedly failed to yield the right-of-way and turned in front of him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Helen Thomas vs. Underwritters at Lloyd's London et al

    PA - Steve Mostyn Jr., J - Milton Shuffield

    The plaintiff is suing her insurance company and one of its agents for allegedly refusing to pay at least a portion of her Hurricane Rita claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    She is seeking actual and consequential damages.

    On Nov. 23 the plaintiff was traveling on MLK Parkway when the defendant allegedly ran a red light and struck the defendant's vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Hazel Adams vs. Margaret Lang-Williams et al

    The family of a deceased Jefferson County man has filed suit against two local doctors, alleging the physicians' negligence led to the man's death.

    Hazel Adams, wife of Joseph Curly Adams, and Glynis Haggerty, daughter of Joseph Curly Adams, claim he died in April 2007 because Drs. Margaret Lang-Williams and Marsha Thigpen failed to properly treat his significant blood loss.

    According to court documents, Joseph Curly Adams, 63, was admitted to Promise Specialty Hospital of Southeast Texas in Nederland on March 29, 2007, with a history of end-stage renal disease and renal cell carcinoma. He also had a status post nephrectomy, a history of tracheal stenosis with chronic repiratory failure, a history of valvular heart disease with subacute bacterial endocarditis, aortic stenosis, congestive heart failure and a history of dementia, the suit states.

  • Ronald Phillips Sr. et al vs. Baptist Hospitals of Southeast Texas et al

    PA - Fredericka Allen, J - Bob Wortham

    A Beaumont couple has filed suit against Memorial Hermann Baptist Beaumont Hospital and two of its doctors, alleging the man suffered multiple injuries after doctors delayed seeing him for several hours.

    Ronald Lee Phillips Sr. was admitted to Memorial Hermann on Oct. 29, 2006, after having a seizure at his home, and another seizure in the ambulance en route to the hospital.

    The suit states that Phillips' doctors, Dr. Darella Cooper and Dr. Jeffrey Klem, were informed of his symptoms late that night but delayed seeing him until morning.

  • James Walter Murray vs. Trans-Global Solutions, Inc. et al

    PA - Bristol Baxley, J - Milton Shuffield

    A railroad worker has filed suit against Econo-Rail Corporation and Trans-Global Solutions, alleging he was injured while working for the railroad.

    James Walter Murray claims he suffered a shoulder injury while attempting to throw a defective switch.

    Murray was working for Kansas City Southern Railway Co. at the Port of Port Arthur on Jan. 11, 2007, when he suffered a temporarily debilitating injury.

    Murray has also filed a similar suit against KCS Railway for this injury.

  • Percy LeBlanc Jr. vs. Jamie Renee Fontaine

    On Jan. 25, 2007, the plaintiff was a passenger in a vehicle that had stopped at a red light on College Street when the vehicle was rear-ended by the defendant.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Linton Chavis vs. Decarlla Lewis

    On Feb. 9 the plaintiff was traveling on Highway 69 when he was in an automobile collision with the defendant. The suit does not state how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

    On March 8 the plaintiff was traveling on Highway 73 when she was in an automobile collision with the defendant. The suit does not state how the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.
