March 10

  • Agnes Wiltz vs. Texas Windstorm Insurance Association et al

    PA – Steve Mostyn, J – Bob Wortham

    The plaintiff is suing the insurance company and at least one of its claims adjusters for allegedly refusing to pay at least a portion of her Hurricane Ike claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    The plaintiff is suing for actual and consequential damages, plus all court costs.

  • Stephanie Brooks and Arica Weaver vs. McCord and McDonnell Inc.

    PA – John Morgan, J – Donald Floyd

    Both plaintiffs were former employees of the defendant and allege they were sexually hired by their supervisors and wrongly terminated.

    The plaintiffs were hired in 2007 and allege they were verbally and physically harassed by "Bebo" McDonnell and his father.

    They are suing for punitive damages, plus lost wages and mental anguish.

  • Sean Steiner vs. Shippers Stevedoring Co.

    PA – Bob Monk, J – Milton Shuffield

    A Jefferson County man has filed suit against a Texas corporation because he says he received injuries after a ladder and other objects dropped on his head while they were being transported with a crane.

    At the time of the incident, Steiner was working for Turner Brothers Crane and Rigging on Oct. 3, the complaint says. Shippers Stevedoring requested Steiner serve as the vessel side flagger while windmill generator units were being unloaded and placed on the dock.

    Because of the incident, Steiner incurred medical costs and experienced a great deal of physical pain, mental pain, anguish, physical incapacity and impairment, according to the complaint.

    He also claims he lost earnings and his earning capacity has been gravely impaired.

  • Larry Long Sr. vs. William Laird

    PA – Pro se, J – Gary Sanderson

    A Beaumont man has filed suit against a local lawyer, alleging the lawyer did not adequately represent his son in a criminal case.

    Larry Long Sr. claims he paid William Michael Laird $1,500 on March 23, 2007, to represent his son, who was charged with aggravated assault. Laird was to receive an additional $1,500 under a contract agreement.

    According to the complaint, Laird said he intended to raise an insanity defense. Disagreeing with that strategy, Long wanted a new lawyer for his son and requested that Laird return some of his money.

    Long, who is representing himself is seeking unspecified exemplary damages, plus pre- and post-judgment interest, costs and other relief to which he may be entitled

  • Krysta Hernstedt-Deal vs. Danica Simien

    PA – Trenton Bond, J – Milton Shuffield

    On Sept. 4, 2007, the defendant allegedly caused an automobile collision. The suit does not state how or where the incident occurred.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Maria Escobar vs. City of Port Arthur

    PA – Barry Bennett, J – Gary Sanderson

    A Jefferson County woman is suing the city of Port Arthur and one of its bus drivers after she claims she was injured when the bus was in a collision at a highway intersection.

    Maria Escobar alleges she was a passenger on a city of Port Arthur transit bus that was involved in a collision on June 25.

    According to the suit, the bus driven by Alfred Granger was traveling north on Texas 347 when he ran a red light at its intersection with Highway 73 Access Road.

    Because of the accident, Escobar claims she incurred medical expenses and suffered injuries to her head, ribs, right shoulder, right ankle, back and lung and experienced physical pain, suffering, mental anguish, physical impairment, physical disfigurement and lost wages.

  • Wandol Nugent vs. Pekin Insurance

    The plaintiff is suing the insurance company for underinsured benefits he says he's entitled to following a Nov. 11, 2007, car wreck.

    The plaintiff is seeking punitive damages, plus all court costs.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, lost wages, medical expenses and impairment.
