April 3

  • Abundant Life Sanctuary vs. Texas Windstorm Insurance Association

    PA - Jason Byrd, J - Milton Shuffield

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Dianna Clayton vs. Ronald Johnson, Michael Fuller, Costa Dallis and Dallis Brothers

    PA - Daniel Clayton, J - Donald Floyd

    The plaintiff, a grieving mother, is suing Johnson and Fuller for stabbing her twin sons, killing one of them. Her sons and the defendants had a dispute at the V-Bar, a bar owned by Dallis near College Station, and were asked to leave.

    The mother claims the bar had a duty to protect her children. She is suing for exemplary damages.

  • Gwen Watson vs. Ayolands Kelly

    On April 13, 2008, the plaintiff was stopped at a stop sign in Beaumont when the defendant failed to yield the right-of-way and struck her vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Tracey Horning vs. Williams A Ambulance, Inc. et al

    A Buna woman has filed suit against Williams A. Ambulance and two of its employees, alleging her wrist snapped while she was attempting to adjust a stretcher.

    Tracey L. Horning, an emergency medical technician with Beaumont-based Williams A. Ambulance, claims she and her partner were dispatched to pick up a patient at Jasper Memorial Hospital on April 20, 2007.

    To transfer a patient from the hospital bed to a stretcher, the stretcher's height must be adjusted so it is similar to the height of the hospital bed.

    In keeping with regulations, Horning was attempting to adjust the stretcher's height. However, she was unable to get the height mechanism to release, the complaint says.

    She is seeking actual damages.

  • Alfred Dennis and Wilma Edwards vs. Lionell Eddie

    On July 16, 2008, the defendant allegedly failed to yield the right-of-way at a stop sign at the intersection of Major and I-10, striking the plaintiff's vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On April 9, 2007, the plaintiff was stopped at a red light on 11th street when the defendant rear-ended her.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Paula Richardson vs. Kroger

    PA - Kent Johns, J - Bob Wortham

    A Beaumont woman is suing a Kroger store over food poisoning she alleges was caused by eating lobster purchased from the market.

    Richardson says she became violently ill after eating a frozen lobster she had purchased from the Kroger located at 3845 Phelan Blvd. in Beaumont on April 14, 2007.

    The complaint says Richardson prepared the lobster on April 16, 2007, and suffered extreme food poisoning after its consumption.

    Because of her illness, Richardson says she incurred medical expenses, suffered physical pain and physical impairment, lost earnings and experienced mental anguish, according to the complaint.
