Employee sues local A/C company for on-the-job injuries

A Newton County man has filed suit against his employer, alleging he was injured while working.

Josh Cheatwood claims he was working for Dominick Faraci Air Conditioning and Heating on July 20, 2007, when he was injured.

Because of his injury, which is not specified in the complaint, Cheatwood suffered physical pain, mental anguish, physical impairment and physical disfigurement and has incurred medical bills, according to the complaint filed April 14 in Jefferson County District Court. He also sustained a loss of his earnings, the suit states.

Cheatwood says Dominick Faraci Air Conditioning and Heating was negligent by failing to provide him a safe place to work, by failing to warn of the dangerous condition, by failing to provide proper tools or proper training and by failing to implement proper procedures and sufficient safety training.

Cheatwood is seeking unspecified actual, punitive and exemplary damages, plus costs, pre- and post-judgment interest at the legal rate and other relief to which he may be entitled.

He is represented by Paul F. Ferguson Jr. of Provost and Umphrey Law Firm in Beaumont.

The case has been assigned to Judge Gary Sanderson of the 60th District Court.
