A Beaumont man and his wife have filed suit against a garbage company, its owner and one of its employees, alleging the man was injured after a collision with a garbage truck.
David and Veta Kennedy say David Kennedy was driving north on Park Meadow Street in Beaumont when he was struck by a vehicle owned by Mr. Garbage and Randall Skipper and driven by Latrick Williams, according to the complaint filed April 17 in Jefferson County District Court.
At the time of the collision, Williams was backing out of a private drive, the suit states.
Because of the accident, David Kennedy says he sustained physical pain, mental anguish and physical impairment and incurred medical expenses. He also lost earnings, according to the complaint.
Veta Kennedy lost the affection, solace, comfort, companionship, society, assistance and household services of her husband and suffered anxiety and panic attacks, the suit states.
Williams was negligent by failing to keep a proper lookout, by failing to safely back out of a private drive and by failing to yield the right-of-way to David Kennedy's vehicle, the Kennedys allege.
They are seeking an unspecified judgment, plus other relief to which they are entitled.
