This Just In: Recent civil suits filed in Jefferson County District Courts

April 9

  • Paula Richardson vs. Kroger

    PA - Kent Johns, J - Bob Wortham

    A Beaumont woman is suing a Kroger store over food poisoning she alleges was caused by eating lobster purchased from the market.

    Richadson says she became violently ill after eating a frozen lobster she had purchased from the Kroger located at 3845 Phelan Blvd. in Beaumont on April 14, 2007.

    The complaint says Richardson prepared the lobster on April 16, 2007, and suffered extreme food poisoning after its consumption.

    Because of her illness, Richardson says she incurred medical expenses, suffered physical pain and physical impairment, lost earnings and experienced mental anguish, according to the complaint.

  • Betty Spears vs. Capitol County Mutual Fire Insurance Co.

    PA - Steve Mostyn, J - Milton Shuffield

    The plaintiff is suing the insurance company for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Nichelle Challow vs. BISD

    PA - David Starnes, J - Gary Sanderson

    The Beaumont Independent School District has been named as a defendant in a lawsuit alleging a student was sexually assaulted while walking home after a bus driver forced her off the school bus.

    Nichelle Challow filed suit on behalf of her daughter, identified only as M.R., against the school district.

    Challow states that a BISD bus driver drove M.R. from Silver Star Babies dance class at Smith Middle School to her neighborhood.

    Although M.R. was normally dropped off in front of her house, on Sept. 9 the bus driver allegedly forced M.R. to walk the final four blocks to her home. During her walk, M.R. was attacked and sexually assaulted, according to court records.

    Because of the attack, M.R. sustained severe personal injuries, emotional trauma and mental anguish and has incurred medical expenses, the complaint states.

  • Evelyn Sims vs. Capitol County Mutual Fire Insurance Co.

    The plaintiff is suing the insurance company for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    Tiger Industrial Rentals vs. R&D Enviromental Services Inc.

    The plaintiff provides goods and services to the defendant and is suing to collect $42,790.53 for an unpaid invoice.

  • Huntsman Petrochemical Corp. et al vs. Houston Pipe Line Co. et al

    PA - Leanne Johnson, J - Bob Wortham

    In May and April of 2007, the defendants performed work at the plaintiffs' facalities and allegedly caused some property damage.

    The plaintiffs are suing for actual and consequential damages, plus attorney's fees.

  • Ofelia Galvan vs. Farmers Insurance Exchange

    The plaintiff is suing the insurance company for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Port Arthur Police Association vs. City of Port Arthur

    PA - Mitch Adams, J - Gary Sanderson

    The Port Arthur Police Association says the city of Port Arthur failed to pay police officers as much as it paid other city workers during Hurricane Ike.

    The association filed a petition against the city asking the court to require the city to arbitrate a grievance it filed.

    Port Arthur Police Association says it filed a grievance with Port Arthur Police Chief W.M. Blanton on Oct. 3 over the city's failure to pay police officers the same rate of pay provided to other city employees during and after Hurricane Ike in September 2008.

  • Sandra Thibodeaux vs. Hnreck Nazarian et al

    PA - Mark Sparks, J - Milton Shuffield

    A Beaumont woman is suing a restaurant chain and its owner, alleging she fell on a slippery ramp.

    Thibodeaux says she tripped on a handicap ramp located at the IHOP at 5875 Eastex Freeway in Beaumont.

    "The ramp was too slippery to be safely traversed, as evidenced by the handicapped person she was assisting on the ramp just prior to her fall," the suit states.

    Because of the fall, Thibodeaux says she sustained permanent and debilitating injuries to her knee, back and elbow and incurred medical expenses. She also lost earnings and suffered physical pain, mental anguish, disfigurement and impairment, the complaint says.

  • Josh Cheatwood vs. Dominick Faraci Air et al

    PA - Paul Ferguson, Jr. J - Gary Sanderson

    Josh Cheatwood claims he was working for Dominick Faraci Air Conditioning and Heating on July 20, 2007, when he was injured.

    Because of his injury, which is not specified in the complaint, Cheatwood suffered physical pain, mental anguish, physical impairment and physical disfigurement and has incurred medical bills, according to the complaint filed April 14 in Jefferson County District Court.

    He also sustained a loss of his earnings, the suit states.

    Cheatwood says Dominick Faraci Air Conditioning and Heating was negligent by failing to provide him a safe place to work,

    The plaintiff is suing the defendant for not honoring its contract and refusing to pay the plaintiff for work performed.
