Plaintiff claims child's fall from balcony due to apartment owner negligence

A Jefferson County man has filed suit against an apartment complex, alleging a young child fell from a balcony while visiting the apartments.

Corey Adams says Jahmal Adams fell from a balcony at The Shire Apartments on April 26, 2006.

Because of Jahmal Adams' fall from the Port Arthur apartment building, he experienced pain and suffering and incurred medical expenses, according to the complaint filed April 27 in Jefferson County District Court.

The Shire Apartments were negligent by failing to maintain the balcony in a safe condition, by failing to warn of the dangerous condition, by permitting the balcony to be defective and by failing to take prudent action to eliminate the dangerous condition, the suit states.

Corey Adams also says the owners and employees of the apartment building negligently failed to put orange tape over the dangerous condition and failed to provide him a safe place to visit.

He is seeking an unspecified judgment, plus pre- and post-judgment interest, costs and other relief to which he may be entitled.

Roger L. Merrill of Merrill and Associates in Houston will be representing him.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
