Woman sues Allstate over auto wreck proceeds

A Jefferson County woman says her insurance company has wrongfully refused to reimburse her for medical costs and other damages she incurred from auto collision.

On May 5 in Jefferson County District Court, Dora Elizabeth Rosiak filed a lawsuit against Allstate Fire and Casualty Insurance Company.

Rosiak claims she was driving in Jefferson County on May 9, 2006, when she was involved in a collision caused by Anselmo Tristan when he failed to yield the right-of-way to her.

Because of the collision, Rosiak says she incurred medical expenses, experienced pain, suffering, mental anguish and physical impairment and lost earnings. She also incurred property damages, the complaint says.

At the time of the accident, Rosiak says she was covered by an Allstate insurance policy that included coverage for uninsured and underinsured vehicles.

Tristan's vehicle was either uninsured or underinsured, and Rosiak made a claim accordingly, she says.

However, Allstate has refused to compensate Rosiak for her damages, according to the complaint.

Rosiak is seeking an unspecified judgment, plus costs, pre- and post-judgment interest and other relief to which she may be entitled.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing her.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
