A Jasper County man is accusing a Beaumont business of breaching an employment contract.
John McKinney says he signed an employment contract with Performance Blasting and Coating.
However, Performance breached the contract, according to the complaint filed May 19 in Jefferson County District Court.
Although McKinney does not specify how Performance breached the contract, he does say the company is guilty of violating the Deceptive Trade Practices Act, quantum meruit negligence, negligent misrepresentation and breach of warranty.
McKinney is seeking actual damages, three times the amount of his actual damages, punitive damages, attorney's fees, costs, pre- and post-judgment interest and other relief to which he is entitled.
John P. Cowart of Moore Landrey in Austin will be representing him.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
