  • Rosailind Simpson vs. Fire Insurance Exchange

    PA - Steve Mostyn, J - Milton Shuffield

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

    The plaintiff claims the defendant is in possession of one of its fishing boats and is refusing to return the plaintiff's property.

    The plaintiff is suing for the return of the property and actual and consequential damages.

    On Feb. 16, 2008, the defendant was traveling on Highway 365 when she was rear-ended by the defendant while stopped at a red light.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Cheryl White vs. Cheryl Motcheck

    PA - David LaRue, J - Donald Floyd

    On May 21, 2008, the plaintiff was traveling on Concord Road when the defendant veered into her lane and struck her vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Joe Fisher et al vs. John Landry et al

    PA - Ed Fisher, J - Donald Floyd

    Joe and Ashley Fisher spent more than $1,000 on Dallas Cowboys tickets which they claim they never received.

    The Fishers filed suit against John Landry and his business, Landry's Tickets.

    According to the suit, on July 6, 2008, the Fishers spent $1,255.70 on tickets for the Dec. 14, 2008, Cowboys and New York Giants game. Landry Tickets was supposed to ship the tickets two weeks prior to the event.

    However, the tickets were never delivered, and the defendant refused to return the couple's phone calls, court papers say.

    The Fishers allege the defendant is liable under Texas' Deceptive Trade Practices Act and are suing for exemplary, actual and consequential damages.

  • Raquel Foster vs. MCM Elegante Hotel

    A Newton County woman has filed suit against a Jefferson County hotel, claiming she slipped and fell while in the bathtub.

    Raquel Lynn Foster says she and her children were staying at MCM Elegant Hotel at 2355 Interstate 10 South in Beaumont when Foster slipped in the bathtub of room 611 and fell.

    "The bathtub in room 611 had an extremely slippery bottom, was not equipped with any type of non-skid material, and Defendant failed to provide a mat or other material for the safe use of the bathtub," the suit filed May 19 in Jefferson County District Court states.

    Because of her fall, Foster says she suffered past and future physical pain, mental anguish, loss of earning capacity, disfigurement and physical impairment. According to the complaint, Foster also incurred medical expenses.

  • Linda McLemore vs. A.O. Smith Corp. et al

    PA - Bryan Blevins, J - Donald Floyd

    An asbestos suit naming 33 defendant companies has been filed on behalf of a recently deceased man, alleging the man's asbestos-related disease were caused by company negligence.

    Linda Dale Baggett McLemore, Larry Donald Baggett and Hazel Baggett claim Lawrence Baggett developed the disease during the course of his work as a laborer and operator.

    A total of 33 defendant companies are named in the suit, including A.O. Smith Corp., A.W. Chesterton Co., Bechtel Corp., Certainteed Corp., Crane Co., Exxon Mobil, Fluor Enterprises, Foster Wheeler, Garlock, GE, Ingersoll Rand, Lockheed Martin, 3M, Owens-Illinois, Union Carbide, Uniroyal Goodrich Tire and Zurn Industries.

    The plaintiffs allege the defending companies failed to adequately warn Lawrence Baggett of the dangers of asbestos exposure, according to the lawsuit.

    They claim the companies also negligently failed to test the products to determine hazards associated with them and failed to remove their products from the market.

    The plaintiffs allege the asbestos-related disease caused Lawrence Baggett to experience physical pain, suffering, mental anguish, disfigurement and physical impairment. In addition, Lawrence Baggett's family incurred medical costs and funeral bills, they claim in the lawsuit.

    On June 17, 2008, the plaintiffs were in an automobile collision with the defendant at the intersection of 32nd Street and 4th Avenue in port Arthur.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On April 3 the plaintiff was stopped on SH 347 in Port Arthur when she was rear-ended by the defendant.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.
