Restaurant employee sues over slip in water puddle

An employee at a popular local eatery says she injured her left wrist after she slipped and fell in a water puddle while on the job.

Bertha Jimenez filed a lawsuit in Jefferson County District Court against Kaware LP, doing business as Easy's.

Jimenez says she was working on Sept. 26 when she slipped and fell in water that had been left standing on the floor.

In addition to the injury of her left wrist, Jimenez says she experienced physical pain and suffering, mental anguish, loss of earning capacity and physical impairment, which she says will continue into the future. She also incurred medical costs, the complaint says.

At the time of Jimenez's injury, Easy's was not a subscriber to the Texas Workers' Compensation Act.

Easy's failed to use ordinary care, failed to protect Jimenez from dangerous conditions, failed to keep the premises safe, failed to inspect the premises to discover latent defects and failed to make any defects safe, according to the complaint.

Jimenez is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief to which she may be entitled.

Tom Oxford of Waldman Smallwood in Beaumont will be representing her.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
