  • Charles Luther Parker III vs. Seashore Transport et al

    PA - James Doyle, J - Dennis Powell

    The plaintiff is suing the defendant corporation for an automobile collision that was allegedly caused by one of its truck drivers on Oct. 6, 2007.

    While traveling on I-10, the defendant driver was attempting to change lanes and struck the plaintiff's vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, impairment, lost earnings and pain, plus attorney's fees.

    On Nov. 20, 2008, the plaintiff entered into a contract with the defendant for remodeling work on its parsonage for $54,845.

    So far, the plaintiff has paid the defendant $48,938 but the defendant has only completed 70 percent of the repairs and refuses to finish the job.

    The plaintiff maintains it has overpaid the defendant for the work completed and is suing for $10,000 in actual damages, plus all court costs.

    On Feb. 25, 2008, the plaintiff was traveling south on Strickland Drive when he stopped at a red light and was rear-ended by the defendant.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, impairment, lost earnings and pain, plus attorney's fees.

  • City of Orange vs. Jerry Simmons

    In lieu of a recent trash ordinance, the city has filed suit against a garbage pickup service, alleging owner Jerry Simmons refuses to enter into a franchise agreement with the city.

    The city contends it will suffer "irreparable harm" if Simmons keeps picking up trash and is seeking a permanent injunction against the defendant.
