Local man sues insurance company over unpaid accident claim

A Jefferson County man says his insurance company has refused to pay him after he was involved in an automobile accident with an uninsured motorist.

Stephen K. Mueller filed a lawsuit July 28 in Jefferson County District Court against Old American County Mutual Fire Insurance Company.

Mueller claims he had a policy from Old American when he was involved in a collision on April 18, 2006, in Jefferson County.

"That accident was caused by the negligence of Louise C. Bonin and Felix Bonin Jr.," the suit states. "Louise C. Bonin and Felix Bonin Jr. are uninsured motorists, as that term has been used in a policy of insurance entered into between the Defendant and the Plaintiff."

Since the accident and with the permission of Old American, Mueller has settled a suit he filed against the Bonins.

But he says the insurance company refuses to pay him "reasonable benefits" for the collision.

Mueller is seeking actual damages, plus pre- and post-judgment interest at the maximum rate allowed by law, costs and other relief the court deems just.

J. Trenton Bond of Reaud, Morgan and Quinn in Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
