Woman in wreck as a child sues driver years later as an adult

After sustaining injuries in a car wreck as a child, an Orange County resident has filed a lawsuit against the woman driving the car seven years ago.

Taylor Wade filed a lawsuit July 30 in Jefferson County District Court against Patricia Greer Smith.

Now an adult, Wade claims she was 11 years old on Aug. 5, 2002, when she was injured while riding in a vehicle Smith was operating.

"Defendant was Northbound on State Highway 124 in Chambers County, Texas, approaching LeBlanc Road when she ran through a red light striking another vehicle," the suit states.

Because of the accident, Wade suffered physical pain, mental anguish and physical impairment, lost her earning capacity and incurred medical costs, the complaint says.

She blames Smith for failing to keep a proper lookout, for failing to stop at an intersection while facing a red light and for failing to yield the right-of-way to a vehicle.

Wade is seeking an unspecified judgment, plus other relief to which she may be entitled.

Michael R. McGown of Benckenstein, Norvell and Nathan in Beaumont will be representing her.

The case has been assigned to Judge Gary Sanderson, 60th District Court.

Jefferson County District Court case number: B184-594.
