  • Allen Mitchell et al vs. Texas Windstorm Insurance Association

    PA - Steve Mostyn, J - Donald Floyd

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Mary Dupuy et al vs. Renee Shields

    PA - Jeffrey Roebuck, J - Bob Wortham

    On Oct. 8, 2008, the plaintiff alleges the defendant rear-ended her vehicle while she was traveling on Highway 366 in Port Neches.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    The plaintiff is suing his insurance provider for not paying him enough benefits for an automobile collision that occurred on April 18, 2006.

    He is suing for actual damages.

  • Columbus Berry Como et al vs. The city of Port Arthur

    On July 10 the plaintiff was riding in his car with his wife on 10th Street in Port Arthur when a city garbage truck ran a stop sign and hit them, killing the plaintiff's wife.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Darryl James vs. Golden Triangle Powersports

    PA - Steve Parkhurst, J - Donald Floyd

    On Jan. 5 the plaintiff brought in his 2005 Kawasaki Vulcan 2000 to the defendant to have the rear tire replaced.

    On Jan. 23 the plaintiff picked up his motorcycle from the defendant and drove off. When he attempted to apply the brakes while traveling on the I-10 service road, he learned the brakes did not work and he was forced to use the front brakes, which caused the bike to flip.
    The plaintiff alleges the defendant failed to reconnect the rear break after installing the tire.

    On top of actual damages, he is suing for past and future mental anguish and medical expenses.

  • Christopher Loc Nguyen vs. Gulf Oceanic Marine Contractors Inc.

    PA - William G. Neumann Jr., J - Donald Floyd

    A Port Arthur man has filed suit against his former employer, alleging he fell out of his bunk bed while working on a fishing vessel after the boat hit a barge.

    Christopher Loc Nguyen claims he was an employee of defendant Sanh Hong Le and worked on Le's fishing vessel, The Jennifer and David.

    Nguyen claims that on Dec. 18 the fishing boat hit a barge and a tug boat owned by co-defendant Gulf Oceanic Marine Contractors Inc.

    "On the occasion in question, Plaintiff was in one of the bunks when the collision occurred with such force and violence that Plaintiff was thrown from the bunk, causing Plaintiff serious injuries," the suit states.

    According to the complaint filed July 30 in Jefferson County District Court, no one was at the helm of The Jennifer and David at the time of the collision. In addition, there were no rails on the bunk beds where employees were sleeping.

    Because of the collision, Nguyen claims he suffered physical pain and mental anguish, lost his earnings and earning capacity and sustained physical

  • Taylor Wade vs. Patricia Smith

    PA - Michael McGown, J - Gary Sanderson

    After sustaining injuries in a car wreck as a child, an Orange County resident has filed a lawsuit against the woman driving the car seven years ago.

    Now an adult, Wade claims she was 11 years old on Aug. 5, 2002, when she was injured while riding in a vehicle Smith was operating.

    "Defendant was Northbound on State Highway 124 in Chambers County, Texas, approaching LeBlanc Road when she ran through a red light striking another vehicle," the suit states.

    Because of the accident, Wade suffered physical pain, mental anguish and physical impairment, lost her earning capacity and incurred medical costs, the complaint says.
