Data company seeks more than $400K for work performed

An Angelina County corporation says it is owed more than $400,000 for work it performed for a Virginia business.

Retail Wholesale Data Information filed a lawsuit Aug. 26 in Jefferson County District Court against Retail Data Services.

RWDI claims it was hired by RDS to go to retail establishments and record various prices of products on the stores' shelves.

RWDI was to be paid according to rates established in an electronic bid proposal.

However, RDS failed to pay the agreed price for jobs RWDI performed from May 2007 until the present, according to the complaint.

"The cumulative total of the amounts owed by RDS to RWDI for these breaches exceeds $400,000," the suit states.

In the two-count suit, RWDI alleges breach of contract and fraud.

It is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus attorneys' fees, costs and pre- and post-judgment interest.

Patrick McGinnis and Ed Downing of Gauthier, Houghtaling and Williams in Houston will be representing it.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
